Overview

This Privacy Policy (“Policy”) describes how KonstructIQ (“KIQ,” “we,” or “us”) collects, uses, and discloses your personal data collected through our websites, services, social media, or other sites that display this Policy (together, the “Services”). This Policy does not apply to our processing of personal data relating to employees of KIQ. Additional or supplemental privacy notices may be made available to you in connection with, and applicable to, certain Services. This Policy does not override any specific contracts agreed to by KIQ and you, and those relationships may be governed by further agreements. If you are engaging with us on behalf of others or your company or otherwise providing the personal data of others, by engaging with us, you acknowledge and agree that you have the consent of that individual. Please discontinue use of our Services if you have any objections to this Policy.

Notice at Collection

We may collect or process various categories of personal data. The section titled “Personal Data We Collect and How it is Used and Disclosed” contains information on the categories of personal data collected. As an overview, we collect identifiers, commercial data, financial data, demographic data, professional or employment-related data, education data, internet, technical, or other similar electronic network activity, and sensitive personal data. We collect this information to provide, maintain, and improve our Services, and for other reasons listed below. Your personal data may be disclosed to service providers, financial service providers, general contractors, subcontractors, homeowners, or other third parties. We will retain your information for as long as needed to fulfill the purposes for which it was collected and to comply with our legal obligations, resolve disputes, and enforce our agreements. We only collect sensitive personal data, such as account or login information along with a password that provides access to the account, to provide our Services, or to evaluate your job application, and we delete this information in accordance with our data retention practices. If you would like to exercise your rights under applicable law, please visit the “Your Rights and Choices” section of this Policy.

Personal Data We Collect and How it is Used and Disclosed

In this Policy, “personal data” means any data or information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household. We may collect personal data from you directly, from the devices you use to interact with us, and from the following sources:

  • General Contractors: Homebuilders, remodelers, and specialty contractor customers.
  • Subcontractors: Construction and specialty subcontractors of our General Contractor customers whose data is processed through the Services.
  • Homeowners: The clients of our General Contractor customers that may engage with our Services and other individuals with whom we have a direct relationship to assist with their home renovation projects.
  • Job applicants: Individuals who apply for positions with KIQ through our website or on third party platforms.
  • Financial Services Providers: Third party partners, like Unit and 5Star, whose products are offered through our Services.
  • Vendors and Service Providers: Other individuals or businesses that assist us with providing our Services, such as online advertising and analytics partners, professional services, and information technology professionals. KonstructIQ uses Plaid Inc. (“Plaid”) to gather your data from financial institutions. By using the Service, you grant KonstructIQ and Plaid the right, power, and authority to act on your behalf to access and transmit your personal and financial information from your relevant financial institution. You agree to your personal and financial information being transferred, stored, and processed by Plaid in accordance with the Plaid end user privacy policy.
  • Website Visitors: Website visitors, prospects, and the individuals who communicate with us, either online or offline.
  • Public Databases: This data may come from local offices that maintain property or permit records, business websites, or trade associations, or from other public sources.

We may use and share information that we aggregate (compile to create statistics that cannot identify a particular individual) or de-identify (strip information of all unique identifiers such that it cannot be linked to a particular individual) at our discretion. We maintain de-identified data in de-identified form, as required under applicable law.

We may disclose any of the personal data outlined above in connection with potential or actual buyers, or their representatives, agents, and advisers in the event of a proposed company purchase, merger, acquisition, reorganization, or similar corporate event.

Cookies and Similar Technologies

We engage online analytics partners that use “cookies” and similar online tracking technologies, such as pixels or web beacons, to collect information such as the server you are logged onto, the domain name of your internet service provider, your browser type and version and your IP address. We may also derive the general geographic area associated with an IP address. At this time, we only use essential cookies that assist us with providing the services.

Your Rights and Choices

  • Your Account: Please log in to update your account information.
  • Email Unsubscribe: If you don’t want to receive marketing emails from us, please use the unsubscribe link in any email you’ve received. Even if you opt out of marketing emails, you may still get emails to complete a transaction that you have already entered with us.
  • Text or SMS Messaging: We may also offer text/SMS messaging to you. In some circumstances, we might require you to opt-in to receive text messages from us. At any time, you may opt-out of receiving particular text messages from us (other than text appointment reminders) by texting STOP in response to any text message.
  • Do Not Track: The "Do Not Track" ("DNT") privacy preference is an option that may be made in some web browsers allowing you to opt-out of tracking by websites and online services. At this time, global standard DNT technology is not yet finalized and not all browsers support DNT. We therefore do not recognize and/or respond to all DNT signals.

KIQ responds to consumer rights requests according to local law. Depending on your U.S. state of residence, the following rights may be available to you, subject to some exceptions:

  • Right to access and portability: You may have the right to confirm whether your personal data is being processed and to get access to it, and a portable format of it, if you request. Residents of Oregon may also request a list of specific third parties, other than individuals, to which KIQ has disclosed your personal data. Where possible and allowed by law, we will provide a copy of the personal data we are processing. For more copies, we may charge a reasonable fee. If you make the request by electronic means, and unless otherwise requested, the data shall be provided in electronic form.
  • Right to correction, rectification, and completion: You may have the right to correct, rectify, or complete your personal data if inaccurate or incomplete.
  • Right to delete or erasure ("right to be forgotten"): You may have the right to the deletion or erasure of your personal data.
  • Right to restriction of processing: You may have the right to request that we restrict our processing of personal data.
  • Right to object to processing: You may have the right to object to processing of your personal data which is based on our legitimate purposes.
  • Right to opt-out of profiling: If we base decisions solely on profiling or automated decision-making that may result in legal or other important effects, you may have the right to opt-out.
  • Right to opt-out of sale, sharing, and targeted advertising: You may have the right to opt-out of the sale of your personal data to third parties. To exercise this right, you may submit a request by contacting us.
  • Right to limit the use and disclosure of sensitive personal data: You may have the right to limit the use and disclosure of your sensitive personal data if we use such information to infer characteristics about you. We do not use your sensitive personal data for these purposes, so KIQ does not provide the right to limit.
  • Right to Nondiscrimination: We will not discriminate against you for exercising any of these rights.

California’s “Shine the Light” Law: California residents may request certain information regarding our disclosure of personal data to third parties for their direct marketing purposes. We do not sell your personal data to third parties for their direct marketing purposes.

Nevada Revised Statutes: Residents of Nevada have the right to opt out of the sale of certain personal data to third parties. We currently do not sell your personal data as defined by Nevada law.

Note that there are restrictions on the number of times you can exercise some of these rights. In some states, you may designate an authorized agent to make a request on your behalf. The agent must provide proof of your authorization. We may deny a request from an agent that does not submit proof that they have been authorized by you to act on your behalf.

We must verify your identity before responding to your request. We verify your identity by asking you to provide personal data that we can match against information we may have collected from you previously. We may need to follow up with you to request more information to verify identity. We will not use personal data we collect in connection with verifying or responding to your request for any purpose other than responding to your request.

We may have a reason under the law why we do not have to comply with your request, or why we may comply with it in a more limited way than you anticipated. If we do, we will explain that to you in our response. You may have the right to appeal a denial of your request by contacting us as described in the notice of denial.

Our Services may contain links to other third-party websites, and this Policy does not apply to third-party websites, mobile applications, or services that may link to our Services or which are linked to from our Services. After you leave our Services, we have no control over the information collected from or about you on those third-party websites. We are not responsible, and assume no liability, for the privacy policies and/or practices of any third-party, and the use of your personal data by third-parties is subject to their privacy policies and terms of use. Accordingly, we encourage you to visit their sites and review their policies.

Public Posting Areas and Social Media

Please note that any information you include in a message you post to any public posting area, such as the comment section of our social media pages, is available to anyone with Internet access. If you don’t want people to know your email address, for example, don’t include it in any message you post publicly. PLEASE BE EXTREMELY CAREFUL WHEN DISCLOSING ANY PERSONAL DATA IN PUBLIC POSTING AREAS. WE ARE NOT RESPONSIBLE FOR THE USE BY OTHERS OF THE PERSONAL DATA THAT YOU DISCLOSE IN PUBLIC POSTING AREAS.

Data Retention

We will retain your personal data for as long as needed to fulfill the purpose for which it is collected and to comply with our legal obligations, resolve disputes, and enforce our agreements.

Data Transfers

If you are visiting our Services from a location outside of the U.S., your connection may be through and to servers located in the United States. Any data you provide during your visit will be processed and maintained on our server and other internal systems located within the U.S. or otherwise as described above. You acknowledge and understand that by providing your personal data to us, your personal data (i) will be processed for the purposes identified above in accordance with this Privacy Policy, and (ii) may be transferred to the U.S. as indicated above, in accordance with applicable law. By using the Services, participating in any of the services, and/or providing us with this information, you acknowledge and agree to this transfer, which may not result in the same level of data protection as the country where you reside.

Children’s Data

Our Services are not targeted to or intended for use by children. We are concerned about the privacy and safety of children when they use the internet. Accordingly, we will not knowingly request personal data online from anyone under the age of 18 without prior, verifiable parental consent. Unfortunately, we cannot always determine the age of a visitor to our sites or user of our Services, so please contact us if you believe we have collected any personal data from an individual under age 18.

Data Security

We implement reasonable physical, technical, and organizational security measures to help protect your personal data. Please understand, however, that no data transmissions over the Internet can be guaranteed to be 100% secure due to the inherent risks of data transmission over the Internet. Consequently, we cannot ensure or warrant the security of any data you transmit to us, and you understand that any data that you transfer to us is done at your own risk. If you create a KIQ account, you are responsible for maintaining the security of your password at all times and you are responsible for activity occurring while logged into your account.

If we learn of a security system breach we may attempt to notify you electronically so that you can take appropriate protective steps. By using the Services or providing personal data to us, you agree that we can communicate with you electronically regarding security, privacy and administrative issues relating to your use of the Services. We may post a notice via our Services if a security breach occurs. We may also send an email to you at the email address you have provided to us in these circumstances. Depending on where you live, you may have a legal right to receive notice of a security breach in writing.
